Minutes of the 98th planning meeting of Wellington Town Council held in the United Reformed Church Hall in Fore Street, Wellington on Monday 9th May 2005 at 6pm
PRESENT: Councillor R. Bowrah (chairman), who presided, Councillors Mrs V. Byrne, Mrs G. Copley, Mrs V. Stock-Williams, Mrs N. Wilson, Councillors P. Critchard, A. Govier, A. Horsman, R. Henley, C. Hindley, G. James, D. Mitton, and E. Warren, the clerk, A. Brown and Taunton DBC West area planning manager Mr J. Hamer. There was an apology from Councillor Mrs K. Biscoe. There were 14 members of the public present.
13249 APPROVED PLANNING APPLICATIONSThe town council received details of applications for planning permission to be determined in accordance with the delegation agreement with Taunton Deane Borough Council of 9th September 1996 and it was resolved to approve planning permission for the following applications: (a) Erection of extensions to provide first floor level (turning a bungalow into a house) at Stable Place, Eight Acre Lane, Wellington as amended by drawing received 30th March 2005 (43/2005/018). There were letters of objection from Mr E. Tyler, of 14 Grange Close, Mrs L. Chetland, of 13 Grange Close, Mr and Mrs P. Wright, of 15 Grange Close, and Mr M. Rose of 17 Grange Close on the grounds of loss of light, overshadowing, visually oppressive, out of keeping with immediate area, invasion of privacy, oppressive size and design, and precedent setting. Plans and photographs were also received from Mr Tyler and Mrs Chetland. A further letter was received from Mr Tyler stating that having seen the second revised amended plans and due to the alterations these contained he wished to withdraw his objection on the loss of light but that the remainder of his objections as in his letter of 23rd March 2005 still stood. Planning officer Mr Hamer recommended approval, stating that amended plans had reduced the size of the side extension to single storey, with a height of 2.6m rising to 4.5m, and provided a hipped roof. The highest point of the dwelling would be about 9m away. Given that the neighbouring property had two large windows in the lounge at the rear of the property and that the side extension had been reduced, he did not consider the proposal would have a detrimental impact on the residential amenity of the neighbouring property. Proposal had 3 first floor side windows on east elevation serving bathrooms that would be made obscure glazing as a condition on the application. There was only one stained glass window on the first floor west elevation. No further first floor windows would be a condition attached to the application, preventing any future overlooking and loss of privacy. Windows to rear of dwelling were about 23m away from neighbouring property. Standing orders were suspended to allow Mr Wright to speak. He felt that the plan was out of keeping with other properties in Grange Close which were mainly bungalows close to the applicant’s property. There would also be overlooking of some gardens. After some discussion the application was approved 7-4 with one abstention. (b) Erection of garage to rear of 6 Champford Mews, Wellington for 94 Mantle Street, Wellington (43/2005/042: The planning officer recommended approval. There was a letter of objection from Mr J. Booker and Miss R. South, of 4 Champford Mews, Wellington, on the grounds of loss of light, condition of wall and storage of flammable materials. Mr Hamer stated that the proposed garage would be only 35cm higher than the existing wall so would have limited impact in terms of loss of light to Champford Mews. The other concerns were not considered to be planning issues. A condition was imposed limiting the use of the garage to domestic use only).2126

13250 SOMERFIELD STORE APPLICATION DEFERREDWith reference to minute 13210 consideration was again given to the application by Somerfield Stores Ltd for the erection of a supermarket (2,187sq.m) and retail unit with first floor offices with associated car parking and servicing, 38-46 High Street, Wellington together with land to rear between High Street and Scotts Lane, formation of a new access to High Street (43/2004/141) and the demolition of Kwiksave Store, 38-40 High Street, Wellington and buildings to rear of 38-40 High Street, Wellington (43/2004/142CA). After it was reported that the traffic report was still awaited from the county council it was agreed to defer a decision on the plan until the June council meeting, the fifth month in a row that the application had been deferred. It was also agreed to hold a special meeting earlier than the normal June meeting if the report was available in time. Strong criticism was again expressed of the county council in holding up consideration of this important Wellington scheme.

13251 CHELSTON CATTLE MARKET PLAN APPROVEDWith reference to minute 13211 consideration was given to the application for the erection of a livestock market comprising covered livestock stalls and sales arena, administrative building and toilet facilities, together with car and articulated vehicle parking, livestock unloading area, vehicle washdown area, site drainage and strategic landscaping and formation of vehicular access onto the A38 on land at Chelston Heathfield, Chelston, near Wellington as amplified and amended by letter dated 16th November 2004 with accompanying environmental statement and drawing No. 1224/1 and letter dated 17th February 2005 (46/2004/018). After some discussion it was agreed to inform Taunton DBC that the town council was in favour of the application.
13252 CHANGE OF USE AND CONVERSION OF 52 HIGH STREETWith reference to minute 13212 consideration was again given to an application for the change of use and conversion of a retail unit (furniture shop) and one dwelling to 7 flats at 52 High Street, Wellington (43/2005/030 and 43/2005/037LB). It was agreed to defer the application pending the receipt of the report of the conservation officer.
13253 COMMENTS TO TAUNTON DBC ON PLANNING APPLICATIONSIt was agreed to inform Taunton DBC that the town council was in favour of the following plans: (a) Retention of garden shed/workshop to rear of 127 Barn Meads Road, Wellington (43/2005/041: subject to a condition limiting use to domestic use); (b) Erection of internally illuminated first floor projecting sign, Nationwide Agency, 4 South Street, Wellington (43/2005/043LB and 43/2005/044A; (c) Erection of 2 bungalows to replace 3 holiday chalets on land to the east of Westford House, Westford, Wellington (43/2005/045); (d) Alteration of pedestrian access to vehicular access, relocation of 1 gate pillar, restoration of 1 gate pillar and new gate leaf to match existing at Westford House, Westford, Wellington (43/2005/046LB); (e) Retention of conservatory to front and erection of conservatory to rear of 36 Longforth Road, Wellington (43/2005/049: providing the side panel of the front conservatory is fitted with obscured glazing to prevent overlooking of the next door neighbour at 37 Longforth Road, Wellington); (f) Subdivision of house into two flats with no external alterations at 42 Mantle Street, Wellington (43/2005/040).

13253 COMMENTS TO TAUNTON DBC ON PLANS (continued)It was agreed to inform Taunton DBC that the town council was opposed to the following plan: (a) Conversion of bakery store building and first floor extension to rear of 13 High Street, Wellington to form a two storey residential dwelling with access from White Hart Lane (resubmission: 43/2005/032: because it will cause considerable overlooking, loss of privacy for neighbours at 2, 3 and 4 White Hart Lane and because, with the proposed first floor extension, it will create an oppressive and overbearing development in a very tight site. It was stated that objections had been received from Mr and Mrs J. Duffy, Mr and Mrs D. Northover and Mr R. Sellers, all of White Hart Lane, on the grounds of loss of privacy and light, and overbearing development).
