Minutes of the 84th planning meeting of Wellington Town Council held in the United Reformed Church Hall in Fore Street, Wellington on Monday 2nd February 2004 at 6.15pm
PRESENT: Councillor R. Henley (chairman), who presided, Councillor R. Bowrah, (vice-chairman), Councillors Mrs V. Bryne, Mrs A. Milne, Mrs V. Stock-Williams and Mrs N. Wilson, Councillors P. Critchard, D. Gill, C. Hindley, A. Horsman, G. James, D. Mitton and E. Warren, the clerk, A. Brown and Taunton DBC West area planning manager, Mr J. Hamer. There was an apology from Councillor A. Govier. There were 4 members of the public present
12586 APPROVED PLANNING APPLICATIONSThe town council received details of applications for planning permission to be determined in accordance with the delegation agreement with Taunton Deane Borough Council of 9th September 1996 and it was resolved to grant full planning permission to the following applications subject to the developments being started within five years of the date of this permission, to the external surfaces of the developments being of materials as shown on the plan hereby approved and to no other materials being used without the written consent of the local planning authority or, in default, by the Secretary of State for the Environment: (A) Change of use from retail to part retail/part light industry at 29 High Street, Wellington (43/2003/134: subject to the following additional conditions (i) Noise emissions from any part of the premises (other than the area indicated as retail on the submitted plan), or land to which this permission refers shall not exceed background levels by more than 3 decibels expressed in terms of an A-Weighted, 5 Min Leq, at any time during the days and times indicated when measured at any point 1.5metres from the façade of any residential or other noise sensitive boundary. Monday-Friday 0800hrs to 1800hrs and Saturday 0800hrs to 1300hrs. At all other times, including public holidays, noise emissions shall not be audible when so measured. Noise emissions having tonal characteristics, eg hum, drone, whine etc, shall not exceed background levels at any time, when measured as above. For the purposes of this permission, background levels shall be those levels of noise which occur in the absence of noise from the development to which this permission relates, expressed in terms of an A-Weighted, 90th percentile level, measured at an appropriate time of day and for a suitable period of not less than 10 minutes; (ii) Odours arising from the printing processes or from any part of the land or from the premises to which this permission relates shall not be detectable at the façade of any residential or other odour sensitive premises. A letter of concern was received from Wilkie, May & Tuckwood, of 27 High Street, about hours of working, soundproofing and smell); (b) Erection of roof over swimming pool at Wellington School, Bulford, Wellington (43/2003/138: Councillor Warren declared an interest and left the room while this application was considered)
12587 REFUSED PLANNING APPLICTIONThe town council refused the following application: Erection of two storey extension at 25 Oakfield Park, Wellington (43/2003/140) because it would cause overlooking and loss of privacy for neighbours. A letter of objection was received from Mrs G. Hooper, of 27 Oakfield Park, on the grounds that the proposed bedroom window would cause of loss of privacy. Mrs Hooper detailed her objection at the meeting and stated that her garden was triangular which increased the overlooking. Mr Hamer recommended approval, pointing out that the rear of the extension would be a minimum of 12 metres from the boundary of 27 Oakfield Park, well within the normal standards for two storey extensions, and would be built at an angle. Any overlooking would be limited and would not be significant enough to warrant refusal. 1980

12587 REFUSED PLANNING APPLICTION (continued)With a distance of 10.5 metres or less from a neighbouring property, the planners would have concerns. Councillor Byrne moved approval subject to obscured glazing being used. This was seconded by Councillor Bowrah but the motion was defeated 7-4. Councillor Horsman moved approval, with Councillor Hindley seconding but this motion was defeated 10-3. Councillor Henley moved refusal on the grounds of overlooking and loss of privacy. This was seconded by Councillor Critchard and carried 7-3 with 4 abstentions.
12588 DEFERRED PLANNING APPLICATIONAn application for the erection of a pre-fabricated single garage at 5 Wharf Cottages, Tonedale, Wellington (43/2004/001) was deferred for a site meeting. It was agreed to hold a site meeting at 10am on Saturday, 7th February 2004 and that if councillors could not attend on that date they would make their own arrangements to see the site. The application was recommended for refusal by the planners on the grounds that the design, siting and external appearance of the garage would be out of keeping with the existing house and nearby properties, would have a detrimental impact on the amenities of occupiers of adjoining properties and would detract from the visual amenities of the locality. It was agreed that a decision would be made on the application at the March planning meeting.
